VCDL prominent on WAVY television channel in Tidewater area *************************************************************** I was interviewed and my comments used in a very well done story on concealed carry in Virginia that ran last night. I have the video, but need to contact WAVY for permission to post it on the VCDL site. The promo they had been running all day yesterday looked like it was going to be a "hit piece," but it turned out to be well done and very balanced. It was in two parts - one ran at 6 PM and the other at 11 PM. VCDL was front-and-center in the 11 PM segment, which listed many of our recent successes in reigning in localities, like Norfolk. Pro-gun Robert Dean was in the first segment and did a great job in representing our side. He is an ex-Va Beach city councilman and is ***running for mayor***. Thanks to Brian Foster for keeping me apprised of the story and helping me get a copy of the video. Other members, like Jeff Bell, checked with me to make sure I was aware of the story. People like Brian and Jeff are the reason that not much slips by without VCDL being aware of it. *************************************************************** 2. VCDL meeting a success, press present *************************************************************** We had an excellent turnout last night. USA Today had a reporter there who covered the meeting and accompanied us to a local restaurant for our normal fellowship meal. The story, which is about the concealed carry movement across the US will run at some point in the near future. I will, of course, advise when it does. He should have interviewed Wayne LaPierre today. I have been contacted by two more major national news agencies that want to do stories involving VCDL. I will advise if anything comes of those requests. *************************************************************** 3. ACTION ITEM FOR Fairfax residents!! *************************************************************** In response to mounting public criticism of the FFX County Police demand that CHP applicants provide specific "proof of address" with their applications or the applications "will be deemed incomplete (see this police directive at page 7 of the circuit court's application instructions at http://www.co.fairfax.va.us/courts/circuit/PDF/SP-248.pdf), at this Monday's hearing on the County's legislative agenda, FFX County Supervisor Michael Frey (R-Sully District) asked for an explanation of this "proof of residence" requirement. After the hearing, VCDL member Paul Kent from Frey's district emailed Supervisor Frey to complain as well about this "proof of residence" requirement. EM Mike Stollenwerk and 5 of his neighbors already had already sent a petition to Supervisor Dana Kauffman in Lee District complaining about this as well. Anyone desiring to help add a little heat to the fire should email your County Supervisor to show your desire that this "proof of residence" requirement be quashed - for email addresses, see http://www.co.fairfax.va.us/government/board. We need to make sure each supervisor hears from 1 or more of their constituents on this ASAP as we have a short window to get this fixed. Here is a sample email: ---------------------- SUBJECT: Halt "Proof of Residence" requirement for CHP Applicants Dear Supervisor __________: I heard that Supervisor Frey asked the County Executive to explain why the Fairfax County Police have constructed their own homemade "proof of residence" test for Concealed Handgun Permit ("CHP") applicants. You may see this police directive at page 7 of the circuit court's application instructions at http://www.co.fairfax.va.us/courts/circuit/PDF/SP-248.pdf, which mistakenly provides in part that: "As part of the Concealed Handgun Application investigation process the Fairfax County Police Department must verify your residence in the County of Fairfax." There has never been any statutory authority for the County Police invented "proof of residence scheme." But over the last two legislative sessions, the General Assembly has amended the Code of Virginia to direct the Virginia State Police to issue CHPs to any eligible person no matter where they live. Furthermore, Va. Code =A7 18.2-308 was amended recently to provide in part that "There shall be no requirement regarding the length of time an applicant has been a resident or domiciliary of the county or city." Since virtually all new residents to Fairfax County will typically be unable to document their residence in the manner that the police demand upon arrival in Fairfax County, the statutory right of new residents to apply for a CHP is clearly infringed by the police "proof of residence" requirement. And some people live in the county for years and still do not possess the documentation that the police decided on their own to demand. I hope you will agree that whatever reason ever existed for this extralegal "proof of residence" requirement has long since evaporated. Please take action to ensure that this requirement is eliminated at the next meeting of the Board of Supervisors. National Parks Petition for Ruling on step closer *************************************************************** VCDL is now reviewing a Petition for Ruling that will require National Parks to look at allowing law abiding gun owners to be able to carry in National Parks. Mike Stollenwerk put it together for us. Once reviewed, we will be getting other gun groups to sign on and then it will be on its way to the Department of the Interior. *************************************************************** 5. Watch for these weekly updates to make sure you haven't been dropped! *************************************************************** If our VA-ALERT detects enough bounces, the offending email address is automatically removed from the VA-ALERT system and the person will need to sign up again. Bounces can be caused by several things - a mailbox that is full, something wrong with your internet provider, or a spam filter gone wild ;-) You should get an email from us no less than every 10 days. *************************************************************** 6. If you are told that you must provide your SSN on a CHP application *************************************************************** Sigh. Two of our members were incorrectly told that they had to provide a Social Security Number on their CHP applications when they applied in Charlottesville. They stood their ground and contacted VCDL. I sent them this information from page 5 of the standard CHP application form that is on the VASP web site - the last sentence summarizes it all: (1) NOTICE TO APPLICANT THIS INFORMATION IS PROVIDED PURSUANT TO THE GOVERNMENT DATA COLLECTION AND DISSEMINATION PRACTICES ACT (SECTION 2.2-3800 ET SEQ). VIRGINIA CODE SECTION 2.2-3800 (C) (10) PROVIDES THAT AN AGENCY SHALL NOT COLLECT PERSONAL INFORMATION EXCEPT AS EXPLICITLY OR IMPLICITLY AUTHORIZED BY LAW. Update on AG restaurant ban opinion *************************************************************** As you know, a lower court judge ruled the restaurant ban unenforceable and on appeal a higher court judge said that may not be true (but no formal ruling has been issued yet). Because this is still in the Courts, I am not expecting Attorney General Kilgore to release an opinion any time soon. *************************************************************** 8. The new Democrats and Gun Rights *************************************************************** A young Democrat has written a two-part article on how the Democrats need to rethink guns. Thanks to Bruce Jackson for links: http://www.useless-knowledge.com/1234/new/article150.html http://www.useless-knowledge.com/1234/new/article159.html The New Dems And Gun Rights (Part 1) By Max Burns Nov. 16, 2004 When Al Gore took a leftward swing towards the end of the 2000 campaign, the chilling effect in his home state of Tennessee was clearly evident. Tennessee, like moderate West Virginia, Arkansas, Missouri and Ohio, has a delicate balance of just how much liberalism they are willing to stomach. When the topic of liberal discussion falls on what is perceived as limiting the rights of gun owners, many swing voters quickly shy away from the Democratic Party. It may be that places like West Virginia, a state that has gone Democrat in three of the past five elections, is forced to choose between the lesser of two evils. When faced with John Kerry, who provided a confusing policy on guns to begin with and capped everything off with a staged duck hunting photo opportunity, West Virginians bolted to the man who they disapproved of economically but knew would protect their right to bear arms. The extent of the worries over John Kerry seems more to blame for losing West Virginia than a sudden surge in popularity by George W. Bush, as West Virginia was one of the few states that went Dukakis in 1988. Losing places like West Virginia must be looked at as a mistake, an error on the behalf of the Democratic Party. That mistake is a direct result of four years of anti-gun rights policy from the very liberal left wing of our party, those who are obsessed with assault weapons bans and long waiting periods. President Clinton's Assault Weapons Ban most likely did far more to hurt the Democrats going into 2000, and continuing into 2004, than anything that has been done recently. To begin repairing this image of Democrats as untrusting elitists who seek to take away the guns of law abiding hunters, we must acknowledge what is true for many moderates - the Second Amendment is an important part of our Constitution. In some state Constitutions, Indiana's for example, the right to bear arms is given to any able-bodied citizen over seventeen years of age, with proper age restrictions for purchasing a firearm and ammunition. This brief position is truly all the Democrats need, as evidenced by the fact that crime rates during the Assault Weapons Ban were no different than the crime rates before the ban was put in place. ------------ The New Dems And Gun Rights (Part 2) By Max Burns Nov. 17, 2004 As mentioned earlier in this section, the Assault Weapons Ban (AWB) did more to hurt the Democratic Party than to help it. Crime rates resulting from the use of firearms went virtually unchanged during the time of the ban, and many moderate Democrats and swing Republicans abandoned the Democratic Party over what they saw as a completely unjust intrusion on their Constitutional rights. The vast majority of gun owners in the United States are law abiding citizens who either own the firearm for personal and family protection or to hunt. These are valid reasons for owning a firearm, and owners should not have come under fire for owning them as they did when the AWB was passed and signed. It is true that owning an assault weapon may worry some Democrats, but the fact that the same weapon with minor modifications could still be sold during the time of the AWB is a fact often overlooked by those seeking to argue blindly for it. Criminals will be able to obtain guns whether or not there are bans in place. That does not make it wrong to attempt to curb some of the weapons being sold, but when the AWB proved to be ineffective, the Democrats should have led the effort to admit their mistake and take the ban down. Instead, several liberal Democrats led the charge to enhance and extend the ban while John Kerry spoke a much different view to voters, who were rightfully confused over the entire issue. The disunity of message in the Democratic Party during 2004 on the issue of the AWB was astounding. Had the ban simply been left to expire without comment, or perhaps touched upon in the past tense by Kerry, West Virginia and Ohio may have swung further his direction. It is understandable to want to protect our children and loved ones, but the AWB attempted to solve these problems in a way that was determined to be not only ineffective, but lethal to moderate and swing voters in their support of the Democratic Party. In order to regain these voters, as well as the South and West, Democrats must be willing to admit that the AWB was a failure from the beginning, as it stressed only cosmetic changes banning a gun from sale. We must be willing to admit that our position in 2000 and 2004 to restrict the ownership and sale of guns was, however noble, on the wrong moral side of the issue. In 2000 and 2004, gun rights was an issue that Democrats, sadly, were simply on the wrong side of. ------------ About the author: Max Burns is a 17-year-old Democrat with moderate, centrist ideals. VCDL member is reminded of crime in National Parks *************************************************************** VCDL Roanoke area gun show coordinator, Al Steed, sent me an email to say his wife and 4 year old grandson had many items stolen from their locked car while parked on the Blue Ridge Parkway. He suggests that you leave packages and valuables in the trunk and that you are alert while on on the Parkway. *************************************************************** 10. VCDL shoot in Roanoke a BIG success! *************************************************************** Al Steed did a fantastic job in coordinating a shoot this last weekend in Roanoke. There were 34 people who competed, 6 new members signed up, lots of prizes handed out, and everyone had a great time. Al has been busy getting the word out on VCDL in the Roanoke area, an important location where we want to have a lot of members. Great job, Al! *************************************************************** 11. British are fed up *************************************************************** There is a growing movement in Britain to roll back laws that protect criminals at the expense of the good people: http://www.stuff.co.nz/stuff/0,2106,3090295a10,00.html The Sunday Telegraph reported that an ICM poll found 71 per cent of British voters believed householders should have the unqualified right to use force, including deadly force if necessary, and 81 per cent thought intruders shou= ld lose the right to sue for any injury suffered by a self-defender. British Home Secretary David Blunkett said through a spokesman the governme= nt was "prepared to consider a specific alternative to the current law, which already allows reasonable force to be used to defend your property, but so = far, nobody has come forward with one". Justice Minister Phil Goff last week called the ACT bill an "Americanisatio= n" and said it would encourage people to take the law into their own hands. Although there was confusion around what was permitted in self-defence, ACT= 's bill would only further confuse people, Mr Goff said. However, Mr Franks said today his bill was initially drafted by a German lawyer who drew on tougher European concepts of legitimate self-defence. The Government's hostility to a law change showed "how extreme its nanny state" was, he said. "By refusing to respond to public demands for a law that better fits what decent citizens already do, and what front-line police recommend they do despite their bosses, Mr Goff makes it likely the pressure will build." *************************************************************** 12. Homeowner fends off burglars in Arlington *************************************************************** This probably frosts Arlington County Board Chairman Chris Zimmerman, who prefers that people be victims, rather than possibly hurting a criminal. (AP) - The search continues for a man who apparently tried to break into an Arlington family's home early Monday. According to police, the suspect got in through a ground floor store on South 26th Road, then made his way upstairs to the residence. But that's where he encountered Herbie the dog - whose barking woke his masters. The homeowner apparently grabbed his gun and fired a shot, but missed the suspect, who police believe grabbed the keys to the family car and drove off in it. *************************************************************** 13. Oklahoma has law protecting guns in parked cars *************************************************************** Whirlpool wants to ban gun in their parking lot, but Oklahoma has a law saying they can't. The law has been temporarily blocked by a judge. This is a contentious issue even within VCDL. I like the law, while others, like Executive member Dennis Fusaro, strongly disagrees with me based on personal property rights. As a practical matter, I personally don't think that a law abiding citizen should ever be told that he can't leave a gun locked in his car in a parking lot. I can go along with not being able to carry into a building or outside the car if the property owner prohibits it. VCDL has not taken a position on this as an organization yet. Here is the story: http://www.foxnews.com/story/0,2933,138512,00.html TULSA, Okla. - In Oklahoma, "Take Your Gun to Work Day" could be every day - but some employers are trying to change that. Whirlpool Corp. (WHR) has sued to block a new law that allows employees to keep guns in their locked vehicles on workplace parking lots. The law was scheduled to take effect Nov. 1, according to the Associated Press, but a federal judge blocked it. Only Kentucky has a similar law. Whirlpool, which is trying to save its ban on firearms (search) on company property, believes workplace safety should override the rights of gun owners. "This is a standard company rule that's intended to protect employees ... and to minimize the risk of any incident occurring," Whirlpool said in a statement to FOX News. Tulsa police are similarly concerned about the prospect of violence in the workplace. Disgruntled employees who wanted to do violence would be "able to have quick access to that gun ... be able to access that facility with that gun, so there's just a quicker step for them to be able to actually use that gun inside that facility," police Sgt. Kim Presley told FOX News. But Oklahoma gun rights activists (search) argue that they should be allowed to keep weapons in their vehicles on employer property because they want to be armed on the ride to and from work. In addition, they believe the state constitution guarantees their right to bear and transport firearms. State Rep. Jerry Ellis (search), a Democrat, believes that keeping guns off employer property won't prevent workplace violence. "People that are going to do violence in the workplace ... it doesn't make any difference how many laws that you have on the books. They have no respect for the law and they're going to do it anyway," Ellis told FOX News. Oklahoma's heavily Republican legislature and Democratic Gov. Brad Henry overwhelmingly support the law, which was drafted after 12 workers who were found to have stored guns in their parked cars on company property were fired. Those 12 are now suing. Malls and daycare - think you're safe? *************************************************************** http://www.washingtonpost.com/wp-dyn/articles/A46854-2004Nov12.html?sub=3DAR Officers fired on: Two men running from Springfield Mall security officers drew weapons, and one fired two shots at the officers Thursday afternoon, but no one was struck and the men escaped, Fairfax County police said yesterday. The two security officers had confronted the men about 4:30 p.m. in the shopping center because they were yelling at others and creating a disturbance. The men ran from the mall and the officers gave chase, police said. Once outside, one man pulled a handgun from his waistband, and the other man drew a long knife. After firing the shots, the men fled behind Franconia Road. -- Teachers should be allowed to be armed in Virginia if they have a CHP. According to officials, two employees were taking trash out of the daycare facility in the 400 block of Lee Highlands Boulevard off South Lynnhaven Road just after midnight when they were approached by a man with a shotgun. The employees say the man stepped out of a car in the parking lot, pointed the gun at them, and demanded money. After giving the man their purses and coats, the suspect told the employees to run. The two ran to a nearby nightclub and called police. One of the employees told WAVY News 10 she feared the suspect was going to shoot them in the back as they ran. The suspect is described as a black male, 25-30 years of age, 6'2" tall, weighing 250 pounds. He was wearing a black shirt and dark pants. He was driving an early 90's model teal or blue four-door sedan, possibly a Dodge or Plymouth. Officials say the suspect should be considered armed and dangerous. Kimbi's Playworld is an extended-hours daycare facility, open seven days a week. Anyone with information about the suspect or the robbery is asked to call the Crimeline at 1-888-LOCK-U-UP. *************************************************************** 15. Letter to the editor on anti-gun editorial in Arlington Sun-Gazette *************************************************************** (I almost typed "Gun-Gazette" ;-) ) =46rom member Clark Welsh: To the Editor, Arlington Sun-Gazette: Ms. Alison Shehan recently (Oct. 21) made some comments in your column regarding some citizens, legally armed, who attended and participated in a meeting of the Falls Church City Council, and I am incensed. "Bullying"? "Threatening"? "Vigilantes"? I'm sorry, Ms. Shehan, but I was one of the pro-gun participants at that Falls Church meeting, and you know absolutely nothing about me. What gives you the standing or the privilege to call me such things? Please, please tell me: who bullied whom and when? There was an armed officer in that meeting room. Don't you think if an individual with a gun began "bullying" anybody, that officer would have been right into it to make an arrest? Since when is participating in open debate in a controlled, civil manner, armed or unarmed, "bullying" or "threatening"? Did you think that if somebody disagreed with someone from the pro-gun side, they were subject to be shot on the spot, say for instance, that young girl who expressed her opinion, just like everybody else there? Do you even grasp the absurdity of such a notion? Virginia gun owners in general, and concealed carry permit holders in particular, are among the most law-abiding, decent, honest people you will ever meet. In fact, that's why we were there. We believe in the law, and in our right, nay, our responsibility to participate in civic matters. At no time was anybody in that meeting in any danger from any of us. How could you even think it? Are we "vigilantes" because we choose to exercise the basic human right of self defense? Would you become a "vigilante" if you chose to resist a rapist, or any other violent criminal by any means at your disposal? Think about it a while, Ms. Shehan, honestly and objectively, because it's painfully obvious that up to this point, you have not.
